"CarSkios," the CarSkios logo, and all other marks displayed on this Site (the "Trade-marks") are registered and/or common law trade-marks of CarSkios and/or various third parties. Except as expressly stated in these Terms of Use, nothing contained on this Site may be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any Site Content or Trade-marks without the prior written permission of CarSkios or the relevant rights holder.

 

CarSkios grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site solely for your own personal, non-commercial purposes, subject to these Terms of Use. This licence does not include any right to:

●       Modify, copy, republish, scrape, or distribute any Site Content;

●       Use any data mining, robots, scrapers, spiders, or other automated data extraction tools (except in strict conformance with the Robots Exclusion Protocol);

Certain features of our Site may require you to register for a CarSkios account. When registering, you agree to provide accurate, current, and complete information, and to update that information promptly if it changes.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately if you suspect any unauthorized access to or use of your account. CarSkios will not be liable for any loss or damage arising from your failure to maintain the security of your account.

You may not sell, transfer, or assign your account to any other person without our prior written consent. Your account is for your personal use only. You may not accept any form of compensation — monetary or otherwise — in connection with actions you take on the Site, such as posting or promoting content on behalf of another person or business.

CarSkios reserves the right to suspend, deactivate, or terminate your account at any time, with or without notice, if we believe you have breached these Terms of Use or have otherwise put CarSkios at legal or reputational risk.

 

CarSkios provides an online platform to connect vehicle buyers and sellers, including private sellers and licensed automobile dealers operating across Canada. The information about vehicles listed on this Site is supplied by the seller or other third parties. CarSkios is not responsible for the accuracy, completeness, or reliability of any vehicle listing information.

CarSkios is not a party to any transaction between vehicle buyers and sellers that originates from information found on this Site. We do not buy, sell, own, or hold title to any vehicle listed on our platform. Any transaction you enter into with a seller is solely between you and that seller.

Listed prices do not include additional fees and charges, such as:

●       Applicable federal and provincial taxes (including GST/HST and QST where applicable);

●       Title, registration, and licensing fees;

●       Licence plate fees;

●       Finance charges and interest;

●       Dealer document preparation fees;

●       Emissions testing or safety inspection fees; and

●       Any other fees or charges imposed by the seller, lender, or applicable government authority.

CarSkios encourages you to exercise caution and good judgment when communicating with sellers and entering into vehicle transactions. Verify the accuracy of all listing information, including the vehicle identification number (VIN), independently before completing any purchase. CarSkios does not endorse or verify any vehicle listings, and we cannot guarantee that any listing is accurate or that the person submitting or responding to a listing is acting in good faith.

 

Interactive Areas

Our Site may include features that allow you to post reviews, ratings, comments, vehicle listings, messages to other users, or other content (collectively, "User Content"). If such features are made available, you are solely responsible for any User Content you submit, and you use those features entirely at your own risk. User Content reflects the views and opinions of the individual users who post it — it does not represent the views or opinions of CarSkios.

Prohibited Content

By using any interactive features on our Site, you agree not to post, upload, transmit, or distribute any User Content that:

●       Is unlawful, false, misleading, defamatory, obscene, pornographic, harassing, threatening, abusive, hateful, discriminatory, or otherwise objectionable;

●       Would constitute or encourage a criminal offence, violate the rights of any party, or create civil or criminal liability under any applicable Canadian or international law;

●       Infringes any patent, trade-mark, trade secret, copyright, or other intellectual property or proprietary right of any party;

●       Impersonates any person or entity, or misrepresents your affiliation with any person or entity;

●       Contains unsolicited commercial communications, spam, advertising, or political solicitations;

●       Discloses the private or confidential information of any third party, including personal contact information, financial information, or government-issued identification numbers;

●       Contains viruses, malware, corrupted data, or any other harmful or disruptive code; or

●       Is unrelated to the purpose of the feature in which it is posted.

CarSkios reserves the right, in its sole discretion, to remove, edit, refuse to publish, or permanently delete any User Content at any time and for any reason, without notice or liability. CarSkios has no obligation to screen, moderate, or monitor User Content, but may do so at its discretion.

Licence to User Content

By submitting User Content to our Site, you represent and warrant that:

●       You own or have all necessary rights to submit that content;

●       The content is accurate and not misleading;

●       Your submission does not violate these Terms of Use or infringe the rights of any third party; and

●       You have the right to grant the licence described below.

By submitting User Content, you grant CarSkios and its affiliates, sublicensees, and successors a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, transferable, and fully sublicensable licence to use, copy, reproduce, adapt, translate, publish, distribute, publicly display, create derivative works from, and otherwise exploit that content in any media or format, now known or hereafter developed, without any obligation to compensate or credit you.

User Content submitted to our Site is considered non-confidential. CarSkios is under no obligation to treat any User Content as proprietary or confidential information.

Moral Rights Waiver

To the fullest extent permitted by applicable law, you irrevocably waive in favour of CarSkios and its successors, assigns, and licensees all moral rights you may have in any User Content you submit to the Site, including any rights of attribution or integrity.

 

In addition to the content restrictions set out in Section 5, you agree that you will not:

●       Access or attempt to access the Site through any automated means, including bots, scripts, spiders, or other automated tools, except as expressly permitted by our robots.txt file;

●       Interfere with, disrupt, or attempt to gain unauthorized access to our servers, networks, databases, or systems, or to the accounts of other users;

●       Use the Site to collect, harvest, or compile any personally identifiable information about other users without their express consent;

●       Reproduce, aggregate, or commercially exploit any data, listings, or content from the Site without our prior written consent;

●       Circumvent, disable, or interfere with any security features, access controls, or technical limitations of the Site;

●       Use the Site for any unlawful purpose or in violation of any applicable federal, provincial, or municipal law; or

●       Engage in any conduct that restricts or inhibits any other person from using or enjoying the Site, or that exposes CarSkios or its users to harm, liability, or reputational damage.

 

CarSkios will only send you SMS or text messages when you have explicitly requested them or when required to deliver a service you have requested.

You may opt out of SMS messages from CarSkios at any time by replying STOP to any CarSkios SMS message, or by texting STOP to 403 000 000. Upon receipt of your STOP request, CarSkios will send you a confirmation message and you will no longer receive SMS messages from us.

CarSkios reserves the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defence of that claim.

CarSkios also reserves the right to modify, restrict access to, suspend, or discontinue any aspect of the Site at any time, including the availability of any feature, database, tool, or content, without notice or liability. We may impose limits on certain features or restrict your access to parts of the Site at any time, without notice.

CarSkios may remove or reject any vehicle listing or user review if we determine, in our sole discretion, that it is false, fraudulent, in violation of these Terms of Use, or in violation of any applicable pricing or advertising guidelines published on our Site from time to time.

 

CarSkios may, at its sole discretion and without prior notice, restrict, suspend, or terminate your access to all or any part of the Site at any time, for any reason, including but not limited to:

●       A breach or suspected breach of these Terms of Use;

●       A request or order from a law enforcement agency or other government authority;

●       Our decision to discontinue or materially change the Site or any feature of it;

●       Technical or security concerns; or

●       Suspected fraudulent, illegal, or abusive activity.

Upon termination, all licences granted to you under these Terms of Use will immediately end. Provisions of these Terms of Use that by their nature should survive termination — including provisions relating to intellectual property, disclaimers, indemnification, and limitation of liability — will continue to apply.

 

These Terms of Use and your use of the Site are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to any conflict-of-laws principles.

Assignment. You may not assign or transfer your rights or obligations under these Terms of Use to any other person without the prior written consent of CarSkios. CarSkios may assign these Terms of Use, in whole or in part, to any third party at any time without notice or consent, including in connection with a merger, acquisition, asset sale, or reorganization.

Notices. CarSkios may communicate with you regarding the Site and your account via the email address you provide during registration. You are responsible for ensuring that your contact information is current and accurate.
